Terms of use

Last updated: September 1, 2026

1. General

Welcome to PIXFLASH (the "System" or the "Service"), a business management system for event photographers, operated by [full business/company name], [business/company registration number], [address] (the "Company", "we").

These terms of use (the "Terms") govern your use of the marketing site pixflash.co.il, the application at app.pixflash.co.il and any related service. Registering, logging in or using the Service constitutes full acceptance of these Terms and of the Privacy Policy, which forms an integral part of them. If you do not agree to the Terms, please refrain from using the Service.

The Terms are written in the masculine form for convenience only and are addressed to all genders.

2. Who may use the Service

The Service is intended for business use only, by photographers, photography studios and event industry professionals. Use is permitted for those aged 18 and over with the legal capacity to enter into a contract. By registering on behalf of a business or company, you declare that you are authorized to bind that entity to these Terms.

3. User account

Opening an account requires complete and accurate details. You are responsible for keeping your login credentials confidential and for all activity carried out in your account, including activity by team members you invited to the System. You must notify us immediately of any unauthorized use.

We may suspend or close an account due to a breach of these Terms, non-payment, unlawful activity or harm to the Service or to other users — after providing notice, except in urgent cases.

4. Trial period, plans and billing

A new user is entitled to a 30-day trial period on the Pro plan, free of charge. A valid payment method is required in order to open the account.

At the end of the trial period, if you have not selected another plan and have not cancelled the account, the account will automatically move to the CRM plan at ₪299 per month (plus VAT as required by law, unless stated otherwise), and billing will be charged to the payment method provided. You may select any other plan at any time.

The subscription renews automatically each month until cancelled. Current prices are published on the pricing page. We may update prices with at least 30 days' advance notice; the update will apply from the billing cycle following the notice.

A plan upgrade takes effect immediately and the difference is charged pro rata. A plan downgrade takes effect in the next billing cycle and may limit access to capabilities or storage capacity of the higher plan.

Payments are processed through a secure external payment provider. Full credit card details are not stored on the Company's servers.

5. Cancellation and refunds

You may cancel the subscription at any time from your account settings or by contacting us. Cancellation takes effect at the end of the current billing cycle, and no further charge will be made thereafter. A charge already made for a period that has begun is not refunded pro rata, unless otherwise required by law.

Cancellation during the trial period involves no charge whatsoever.

To the extent that the provisions of the Israeli Consumer Protection Law, 1981 apply to the engagement, the cancellation rights set out therein shall apply in addition to the above.

6. Your content and data

All information you enter or upload to the System — leads, client details, contracts, photos, videos, financial documents and more ("User Content") — remains your property. You grant the Company a limited license to store, process and display the content solely for the purpose of operating the Service for you.

You declare that you own the rights in the User Content or hold lawful permission to use it, and that the content does not infringe third-party rights, including copyright, privacy and publicity rights.

With respect to the personal data of your clients managed in the System, you are the "database owner" as defined in the Israeli Protection of Privacy Law, 1981, and the Company acts as a "holder" on your behalf. You are responsible for fulfilling your obligations under law, including obtaining consents, providing notices to data subjects and registering a database where required.

We may remove content that breaches the Terms or the law, after notice where possible.

7. Digital signing of contracts

The System allows your clients to sign contracts electronically. The resulting signature is an electronic signature as defined in the Israeli Electronic Signature Law, 2001, and is stored together with the identification details, the timestamp and a copy of the contract as signed.

You are solely responsible for the content of your contracts, their legality and their suitability to your business. The Company does not provide legal advice and does not warrant the enforceability of any contract. We recommend consulting a lawyer when drafting your contract templates.

8. WhatsApp messaging and mailings

The System allows automated messages to be sent to your clients, including via WhatsApp, SMS and email. You are solely responsible for obtaining recipients' consent to receive the messages, for their content and for their compliance with the law, including section 30A of the Israeli Communications Law (Telecommunications and Broadcasting), 1982 (the "Spam Law") and the terms of use of the messaging providers.

Message delivery depends on third-party services (such as Meta/WhatsApp), and the Company is not responsible for their availability, for changes in their policies or for numbers being blocked following recipient reports.

9. Receipts, invoices and financial data

The payment management and document issuing capabilities in the System are operational aids. You are solely responsible for the accuracy of the data, for reporting to the tax authorities and for complying with the bookkeeping rules applicable to you. Issuing accounting documents is performed, where relevant, through an authorized third-party provider, subject to its terms. The Company does not provide tax or accounting advice.

10. Storage, backup and data export

Storage capacity is determined by your plan. Exceeding the capacity may require an upgrade or the deletion of files. We perform routine backups as part of operating the Service, but the System is not intended to serve as a sole archive — you must keep independent backup copies of original photography files and of essential documents.

After the subscription ends, you will have a period of 30 days to export your data. At the end of that period we may permanently delete the User Content, subject to retention obligations under law.

11. Permitted and prohibited use

In using the Service, you undertake not to:

  • Use the Service for any unlawful purpose or contrary to these Terms.
  • Upload offensive or infringing content, malicious code or content that harms the privacy of others.
  • Attempt to breach the System, disrupt its operation, circumvent usage limits or reverse engineer it.
  • Copy, sell, rent or sublicense the Service or any part of it.
  • Send unlawful mailings through the System or messages to recipients who have not consented.
  • Use the Service to collect information about other users or to harm them.

12. Intellectual property

All rights in the System — including the code, design, interface, trademarks, logo, site texts and documentation — belong to the Company or its licensors and are protected by intellectual property laws. You are granted a personal, limited, non-exclusive and non-transferable license to use the Service in accordance with these Terms and the plan you purchased.

Feedback, ideas and suggestions you provide to us may be used freely by the Company without consideration.

13. Artificial intelligence capabilities

The System includes AI agents that assist with support, marketing, operations and client service. AI outputs are provided as assistance only, may be inaccurate or incomplete, and do not constitute professional advice. You are responsible for reviewing the outputs and for any action based on them.

14. Service availability and changes

We strive for high availability, but the Service is provided "AS IS" and "AS AVAILABLE". There may be interruptions for maintenance, updates or faults beyond our control. We will endeavour to give advance notice of planned maintenance.

We may update, change, add or remove capabilities in the Service from time to time. A material change that reduces capabilities in the plan you purchased will be brought to your attention in advance.

15. Third-party services

The Service integrates with external services (payment processing, messaging, email, storage, document issuing and more). Their use is subject to their terms, and the Company is not responsible for their operation, availability or changes.

16. Limitation of liability

Subject to any law, the Company, its directors, employees and suppliers shall not be liable for any indirect, consequential, special or punitive damage, including loss of revenue, loss of data, loss of clients or damage to reputation, arising from the use of the Service or the inability to use it.

The Company's total aggregate liability on any cause of action shall not exceed the total payments you actually paid to the Company in the 12 months preceding the event giving rise to the claim.

Nothing in the above derogates from liability that cannot be limited under law.

17. Indemnity

You undertake to indemnify the Company for any claim, demand, damage or expense (including legal fees) arising from your breach of these Terms, from your User Content, from messages sent through your account, or from your infringement of third-party rights or of the law.

18. Changes to the Terms

We may update these Terms from time to time. We will give notice of a material change through the System or by email at least 14 days before it takes effect. Continued use of the Service after that date constitutes acceptance of the updated Terms. The current version will always be published on this page.

19. Governing law and jurisdiction

These Terms shall be governed solely by the laws of the State of Israel. Exclusive jurisdiction over any dispute arising from these Terms or from use of the Service is granted to the competent courts in the Tel Aviv–Jaffa district.

If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force. The Company's failure to exercise a right does not constitute a waiver of it.

20. Contact

For questions regarding the terms of use you may contact us by email at [email address], by phone at 055-936-3701 or through the contact page on the site.
